This Agreement entered into between Salsgiver, Inc., a Pennsylvania corporation, (hereinafter "SI") and Subscriber (hereinafter "Subscriber").
WHEREAS, SI provides access to the Internet, VOIP Telephone and IPTV Television; and
WHEREAS, Subscriber wishes to purchase access to one or more of these services;
The parties mutually agree as follows:
COST
For an agreed upon fee for your particular service, SI will provide
Subscriber access to services.
Internet
Not all SI Internet packages include unlimited data. Your Internet package may have
pre-defined transfer limits. Subscribers are responsbile for paying
all data overages that vary on the package subscribed to. In addition SI may choose
at it's sole discretion to move any user to an advanced package based on data use.
VOIP Telephone
Only Residential accounts have unlimited domestic calling to the 48 continuous
states and Canada. All other calls will be billed at prevailing rates.
Residential Subscribers consuming more than 1000 minutes on a monthly basis and at SI's sole
discretion may not qualify for Residential rates and may be moved to
Business billing.
All Business lines unless otherwise noted have unlimited local and
500 minutes of domestic calling included. Domestic calling is limited to
the 48 continuous states and Canada.
Subscribers are responsible for all telephone charges including fraud.
Subscribers are responsible for any and all costs to SI for any breach of their networks.
If requested, subscribers are required to provide assistance in traceback investigations into the origins of illegal calls.
Payment
Payment in full is due within
15 days of receipt, payable by check, money order, Visa, Mastercard, or
Discover to SI. Subscriber will be sent an invoice every month until SI
is notified in writing that Subscriber wishes to cancel. Subscriber may
cancel at any time. Accounts can only be cancelled if they have a $0 balance. All past due accounts will be surcharged a 5% late fee.
All returned checks will be charged a $25.00 return fee. Accounts delinquent
in excess of 30 days will be terminated. All delinquent accounts will
be charged with an additional reasonable collection fee and turned over
for collections. All accounts are non-refundable. SI retains the right to hold any equipment in their possession until any outstanding balance is paid in full. SI retains the right to sell any held equipment 90 days past account termination due to non-payment. Procedes of equipment sale will be applied to any outstanding balances. SI retains the right to
change the access fee and/or terms of access without notice to Subscriber.
Each account has a quota for e-mail and web pages. If additional storage is required, it can be purchased for a low monthly fee.
TERMS and CONDITIONS
SI reserves the right to remove any pages/activities that significantly hinder the server performance unless other arrangements have been made between the parties.
Dialup Users
Out of consideration for others, log out when you are no longer using our service. Connections which are inactive for more than 1 hour will be disconnected. In addition, all non-dedicated accounts are subject to a session time limit. This is not a limit to the connect time per day, however any account which reaches this limit multiple times a day on a regular basis will be forced to move to dedicated line pricing.
SI reserves the right to terminate service for Subscribers who are not in compliance with the following terms and conditions:
Any attempt to log into an account on our system, other than the account which has been assigned to you is strictly prohibited.
Any access to other networks through SI must comply with the rules appropriate for that other network.
Internet access provided pursuant to this Agreement may only be used for lawful purposes. Transmissions of any material in violation of any U.S. or state regulation is prohibited. ns of any material in violation of any U.S. or st

d material, including software, material provided by other services, material le
gally judged to be threatening or obscene, or material protected by trade secret
AUTHORIZATION FOR USE
Subscriber represents that all users of the Internet access covered by this Agreement are 18 years of age or older or, will be supervised by a parent or guardian who is over the age of 18.
SECURITY
Subscriber is responsible for securing their own networks.
Use of any information obtained via this Internet access service is at your own risk. SI specifically denies any responsibility for the accuracy or quality of information obtained through its services.
SI makes no warranties, either express or implied, as to any matter whatsoever, including without limitation, the services rendered pursuant to this Agreement. SI also disclaims any warranty of merchantability, fitness for a particular purpose, or any implied warranties of fitness.
SI is not required, pursuant to this Agreement, to provide any technical support to Subscriber. In the event, however, that SI chooses, in its sole discretion, to provide such technical support, Subscriber hereby releases SI from any and all claims of liability of any kind as a result thereof, including but not limited to claims for damage to software, or hardware, lost data, lost profit and/or business interruption.
Subscriber agrees to defend, indemnify and hold harmless SI from any and all claims, causes of action or damages of any kind, resulting from Subscriber’s use of the services provided pursuant to this Agreement.
This agreement constitutes the entire Agreement between the parties and shall be governed by the laws of the Commonwealth of Pennsylvania.
Accessing SI's network binds the subscriber to the terms of this access agreement. SI may choose to terminate access to subscriber for any reason. If SI exercises its right to terminate subscriber's access any account balance will be refunded according to SI's posted refund policy.
